Authorlee v. Tuboscope

Multiple plaintiffs sued firm client AMF and another party in an attempt to set aside a final judgment relating to a $52 million dollar settlement arising from alleged exposure to silica dust. The Plaintiffs asserted fraud between defense counsel and plaintiff’s counsel resulting in an improper aggregate settlement. Beck Redden partner Troy Ford argued to the trial court that final judgment should not be set aside.  The trial court agreed and Plaintiffs appealed to the First Court of Appeals.  Ford argued to the Court of Appeals which upheld the trial court and refused to set aside the settlement. Plaintiffs then appealed to the Texas Supreme Court and the Court requested full briefing. Upon receipt of the briefing the Texas Supreme Court denied review of this matter ending the litigation and keeping the original settlement agreement intact.
