Trial Victory Protecting Minority Rights in Closely-Held LLC Company

In August 2024, after a week-long trial, a Harris County jury delivered a complete verdict in favor of Beck Redden’s client, a minority owner of a closely-held LLC, in a dispute over breaches of fiduciary duty and violations of the company’s operating agreement. The case arose after the client was excluded from key business decisions, denied access to important company information, and witnessed other members unjustly enrich themselves at his and the company’s expense.
Beck Redden filed both direct claims on behalf of the client and a derivative suit on behalf of the company. The jury found that the defendants had breached their fiduciary duties and the company’s operating agreement, and it rejected all counterclaims brought against the client.
On August 16, 2024, the Court entered a final judgment awarding the client $1,925,908.45 in damages, attorneys’ fees, court costs, and pre- and post-judgment interest. The defendants received nothing.
