Chan Park v. ExxonMobil Corp

The Texas Supreme Court upheld a victory for Beck Redden client ExxonMobil Corp. in a case involving a holdup at a service station. Chan Park filed suit after unknown criminals held him up in the early hours of the morning at a station in Dallas near the interstate. The trial judge threw out his lawsuit against the company, and the Dallas court of appeals agreed, based on a thorough analysis of the so-called Timberwalk factors. The Supreme Court has now denied the plaintiff’s petition for review.

Beck Redden appellate partner David M. Gunn worked on the appeal with his colleague, John Adcock. Mr. Gunn gave the oral argument in the Dallas court of appeals.
