Beck Redden attorneys Jackie Furlow and Geoff Gannaway prevailed on behalf of their client yesterday. The matter, which had been pending since 2014, involved an action for enforcement of the property division in the parties’ divorce decree. The decree awarded the parties’ marital home to our client, the former wife, but because the decree did not contain common decretal language, a protracted dispute ensued concerning the validity and enforceability of the divorce decree. The proceedings involved several hearings in the trial court and a mandamus proceeding. Beck Redden finally prevailed, with the judge ordering that the divorce decree serve as a muniment of title for the residence. Our client is overjoyed that she and her young children are able to stay in the home.
