Beck Redden LLP stepped up on short notice to defend HP Inc.  (“HP”) in a high-stakes legal battle against its former supplier, who sought $45 million in damages for breach of contract, breach of the implied covenant of good faith and fair dealing, and fraudulent inducement. The trial took place in state trial court in Albany, New York.

After four days of trial, the jury delivered a swift and unanimous verdict in favor of HP, reaching their decision in just over 30 minutes. Beck Redden’s strong defense demonstrated that the plaintiff failed to meet its burden of proof on all claims. Further bolstering the defense strategy, the Court excluded the plaintiff’s damages model before its expert could testify, holding that the damages model violated previous rulings by the trial court and appellate court, and sought damages not available under New York law.

Due to Beck Redden’s zealous advocacy, the plaintiff withdrew two of its claims before the jury was charged, leaving the jury to answer only the question of whether HP breached the contract. The jury’s verdict echoed the defense, finding that HP did not breach any terms of the contract.

This was a long-awaited victory for HP, who had been defending against the lawsuit since it was filed in 2017. Beck Redden’s trial team included partner Alistair B. Dawson and associate Fariha Jawed.
