Ava Washington v. Margaret Victoria

Beck Redden secured a significant appellate victory for appellant Ava Washington in a contested probate proceeding against appellee Margaret Victoria. The First Court of Appeals reversed a jury verdict finding that the decedent had testamentary capacity to execute the challenged will.

In a 56-page opinion, the First Court of Appeals reversed after holding that the trial court abused its discretion by excluding crucial evidence that Washington sought to present to respond to a key issue in the case. The First Court held that “once [the Appellants] were permitted to introduce evidence about” this issue, “it was an abuse of discretion for the court to exclude Ava’s attempt to introduce evidence on that matter.” The Court held that this error was harmful because it left the jury with a false impression. The First Court reasoned that “[g]iven the importance Margaret’s counsel placed on the challenged evidence and the focus her counsel placed on the evidence during closing, we cannot conclude that the evidence was irrelevant or insignificant to a key issue.” The Court reversed and remanded for further proceedings.
