Plaintiff Win in Louisiana Supreme Court Rules Amazon is a Seller Under State Products Liability Act

Beck Redden LLP served as lead appellate counsel for Plaintiffs, Angela Pickard, et al., in a personal injury lawsuit in the Western District of Louisiana against Amazon.Com, Inc. The federal court certified two questions to the Louisiana Supreme Court: (1) whether Amazon is a “seller” under the Louisiana Products Liability Act and (2) under what circumstance, if any, Amazon may be liable under the theory of negligent undertaking. The Louisiana Supreme Court ruled favorably to Plaintiffs, holding that Amazon is a seller under the Louisiana Products Liability Act and that Amazon may be liable for injuries if, subject to standards established by standard undertaking law, Amazon assumed a duty to identify and remove unreasonably dangerous products from its marketplace. The opinion issued June 28, 2024.
